A preliminary hearing is set for Thursday for a Navy sailor charged with negligent homicide in the death of a fellow sailor, service officials said.
The Article 32 hearing will determine whether a court-martial moves forward for the charged sailor who has not been identified by the Navy.
An Article 32 hearing is a legal proceeding that takes place under the Uniform Code of Military Justice to determine whether there is enough evidence to try a service member in a court-martial.
The sailor was charged with negligent homicide in November in the death of Petty Officer 3rd Class Lyndon Joel Cosgriff-Flax. The 22-year-old master at arms died during a reported man overboard incident at Weapons Station Yorktown, Va.
The unnamed sailor, also assigned to the Yorktown station, is facing additional charges of making a false official statement and two counts of dereliction of duty, Navy Region Mid-Atlantic said Wednesday.
The charges date back to an April 28, 2024, harbor security boating incident that resulted in the death of Cosgriff-Flax.
Cosgriff-Flax, who was assigned to the installation’s security department, was participating in a training and area familiarization exercise on the York River at the time of his death.
Officials initially reported he had fallen overboard but provided few details as the investigation was ongoing.
